Load-shedding theft and loss of service has an impact on leases...
There are a number of consequences of load-shedding, which include cable theft while the power is out, cutting of alarm systems without backup, and in general we are facing an increase in theft, water outages etc.
This also has consequences for landlords and tenants who may be without power or water for extended periods and increased theft from the premises - even air-conditioner units.
The question is who is responsible for the costs of restoring and fixing these as between landlord and tenant.
It is something that needs to be addressed in the current and new leases as well as possibly the increase in the cost of security at the premises.
If you are a landlord or tenant it would be a good idea to check your leases and in advance of a problem either discuss the possibilities with your landlord or tenant, as the case may be, and make provision for this in your lease document. Mc Naught and Co can help you create suitable clauses dealing with these new South African realities.
