Getting married Out of Community of Property
Case study…
“I want to marry out of community of property. The issue is I don’t have much money to hire a lawyer to handle the proceedings; Can I do it myself? How does one go about the process of such and how long does it usually take. I plan to marry in December.”
Mc Naught and Co says:
An Antenuptial Contract is required to get married out of community of property. This is a Notarial document that needs to be signed before a Notary Public who is an attorney with the additional notary’s qualification. Mark of Mc Naught and Co. is a Notary Public and there is a charge for this. Thereafter the Notarial Deed needs to be registered at the Deeds Office. There is also a charge for this. There is no getting around this except to perhaps ask a family member to give this to you as a wedding present.
There are various forms the Notarial contract can take – it can include or exclude the accrual system of marriage and you can also insert special conditions into the contract and should be advised properly before you have the contract draw up and signed as it guides the future of your marriage system.
The present total cost of execution and registering of an ANC is R2850,00.
Book yours today – it needs to be signed at least BEFORE you get married – and you have 90 days after the marriage for the lawyer to register it in the Deeds Office.
