FAQs

Once a dispute cannot be resolved amicably, the services of a litigation lawyer will be required to help resolve the matter – using either skilled negotiations or a form of alternate dispute resolution to achieve a settlement or to bring a case to court.
Besides South Africa, we have successfully represented our clients in cross-border litigation matters in Southern Africa, further afield on the continent (Nigeria), and internationally in the United Kingdom, New Zealand and Russia.
Litigious matters need not only be resolved through the court systems. Mediation and arbitration are alternative methods for dispute resolution, allowing individuals or companies to come to an agreement privately about a situation that might otherwise be litigated through the courts. The aim is to achieve an expeditious, cost-effective resolution to all our client’s disputes.

What are the benefits of arbitration and mediation?

  • More cost-effective than court proceedings
  • Less formal than court proceedings
  • Processes are faster than going through the courts
  • Matters remain private (not part of the public record)

With you in the long run...

Mc Naught & Co took on the case of long-distance runner Alexandra Morozova who was banned by the Comrades Marathon Association from competing in the 2022 race on the grounds of her Russian nationality.

Our firm’s victory in the Pietermaritzburg High Court not only saw Morozova compete in – and win – the race, but also paved the way for 30 more Russian athletes to be allowed to compete in the Comrades in their seeded positions and not at the back of the pack.

A previous court victory for the firm also saw a ban on paying Morozova her prize money for coming second in the 2017 race overturned.
